2. Ownership of Content:
All content produced by Truman Terracotta, including but not limited to videos, photographs, and other media ("Content"), remains the sole property of Truman Terracotta unless otherwise specified in writing. Clients are granted a non-exclusive license to use the Content for the purposes outlined in the agreement between the Videographer and the client. Ownership of the Content is not transferred to the client unless expressly agreed upon in writing.
3. User Responsibilities:
Users of the Website agree to use the services provided by Truman Terracotta in accordance with all applicable laws and regulations. Users are responsible for providing accurate information and obtaining any necessary permissions or licenses for the use of the Content.
4. Payment Terms:
Payment for videography services is due as outlined in the agreement between Truman Terracotta and the client. Failure to make timely payments may result in suspension of services and/or legal action to recover outstanding fees.
5. Limitation of Liability:
Truman Terracotta shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the services provided by Truman Terracotta, including but not limited to any loss of profits, data, or goodwill.
6. Indemnification:
Users agree to indemnify and hold harmless Truman Terracotta from any claims, liabilities, damages, expenses, or losses arising out of or related to the user's use of the services or any breach of these Terms.
7. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
